The Circuit Court of the County of Franklin, part of the 22nd Judicial Circuit Court of Virginia, is the court of record in the County and has general jurisdiction of all types of cases - civil, equity and criminal.  In addition the Circuit Court is the court to which appeals from the General District Court and the Juvenile and Domestic Relations Court are taken.

The Clerk of the Circuit Court is responsible for the recording of deeds, deeds of trust, mechanics liens, plats and other miscellaneous instruments on the land records books; docketing of judgments and filing of financial statements under the Uniform Commercial Code.  The Clerk files and processes all law and chancery suits including motor vehicle accidents, divorces, injunctions, land partitions, appeals from General District Court, adoption proceedings, and name changes.  Duties also include issuance of marriage, hunting and fishing licenses; processing indictments for both felony and misdemeanor cases; jury scheduling; probating wills, appointing administrators, trustees, and guardians; and collecting fines and costs for Circuit Court.  All records of this office are open to the public with the exception of sealed juvenile and adoption records.  The Clerk of Circuit Court is elected by Franklin County citizens every eight years.

The General District Court decides all criminal offenses involving ordinances, laws and bylaws of the State, County and Town, and all misdemeanors, including traffic offenses, under state law; decides civil cases in which the amount in question does not exceed $25,000.  The General District Court also holds preliminary hearings in felony cases to determine whether or not there is sufficient evidence to justify holding a defendant for a grand jury hearing.  All cases are heard by a judge.

The Juvenile & Domestic Relations District Court handles cases involving delinquents, juveniles accused of traffic violations, children in need of services, children in need of supervision, children who have been subjected to abuse or neglect, spouses or household members who have been subjects of abuse, adults accused of child abuse or neglect, adults involved in disputes concerning the support, visitation, parentage or custody of a child, abandonment of children, foster care, court ordered rehabilitation services, and court consent for certain medical treatments.

The Commonwealth's Attorney represents the State in criminal cases and is the chief prosecuting officer for Franklin County.  The Commonwealth's Attorney is elected by Franklin County citizens every four years.

The Sheriff of Franklin County, a constitutional officer elected for a term of four years, is responsible for law enforcement services, maintaining courtroom security at each of the courts, operation of the jail, transporting prisoners and mental patients, and serving civil papers in the County.

Juvenile Court Service Unit


The 22nd District Court Service Unit, an agency of the Virginia Department of Juvenile Justice, provides a full range of service to children and families under the jurisdiction of the Juvenile & Domestic Relations District Court.  Basic services include intake/diversion services, investigation and report services, probation and parole supervision, family, and marital counseling, and selective substance abuse testing. Hours are 8:15 am - 5:00 pm (Monday - Friday)

Adult Probation & Parole


This department prepares background investigations of defendants for the Circuit Court, supervises individuals placed on probation by the courts and offenders paroled by the Virginia Parole Board.



Magistrates are authorized to issue arrest and search warrants; to issue Emergency and Temporary Custody Orders, Emergency Protective Orders, commit to jail and admit to bail persons charged with offenses.  The Magistrate's office is located in the brick building directly across from the jail.
